TERMS & CONDITIONS

Effective upon use of this website or purchase of any Gambaro piece.

By accessing this website or completing a purchase, you agree to these Terms. Nothing in these Terms excludes or limits liability where such limitation is not permitted under applicable law.

1. General

Gambaro operates under the laws of the Republic of Colombia. We reserve the right to update these Terms at any time. The version published at the time of purchase applies.

2. Product Nature

Gambaro pieces are handcrafted sculptural objects produced in limited quantities. Natural variations in tone, polishing marks, surface texture, weight distribution, and gemstone characteristics are inherent to artisanal production and do not constitute defects. Availability, specifications, materials, and pricing may change without prior notice.

3. Orders

Placing an order constitutes an offer to purchase. Orders are subject to review and acceptance. The purchase contract is finalized once confirmed and dispatched. We reserve the right to cancel orders due to pricing errors, technical inaccuracies, suspected fraud, payment issues, or stock unavailability. If payment has been processed, a refund will be issued to the original method.

4. Pricing & International Charges

Prices are displayed in the selected currency. For international shipments, customs duties, VAT, import taxes, and similar charges imposed by destination authorities are the sole responsibility of the recipient. In the event of a return or exchange, Gambaro does not refund shipping costs, customs duties, VAT, import taxes, or similar third-party charges.

5. Shipping & Risk

Orders are prepared with care and processed within a reasonable timeframe. Delivery timelines vary by destination and carrier conditions. Tracking is provided when available. Risk of loss transfers upon confirmed delivery to the address provided at checkout, without prejudice to applicable warranty rights. Gambaro is not responsible for courier delays, customs retention, incorrect shipping information provided by the customer, force majeure events, or circumstances beyond reasonable control.

6. Returns & Exchanges (14 Days)

Requests must be submitted within fourteen (14) calendar days from the date the piece is received. Eligibility requires: unused and unworn condition, perfect structural and aesthetic state, no scratches, marks, bending, resizing, deformation, or alterations, and complete original packaging and materials. Custom-made, resized, engraved, personalized, or special-order pieces are not eligible. Shipping costs related to returns or exchanges are the responsibility of the customer. Refunds apply exclusively to the product price paid. Shipping costs, duties, VAT, import taxes, and similar charges are non-refundable.

If the replacement piece exceeds the original purchase value, the price difference must be paid prior to shipment. If the replacement piece has a lower value, a non-refundable store credit will be issued. No cash refunds apply to exchange differences. All returns and exchanges are subject to inspection and approval.

7. Manufacturing Defects & Warranty

Gambaro guarantees structural craftsmanship and manufacturing integrity under the following conditions.

Visible Manufacturing Defects (14 Days)

Must be reported within fourteen (14) calendar days from delivery. Limited to: incorrect item delivered, major structural deformation present at delivery, loose setting present at delivery, missing or incorrectly mounted gemstone, faulty clasp not functioning upon first use, obvious assembly failure identifiable without wear. Natural gemstone inclusions, tonal variations, or polishing marks are not defects.

Structural Manufacturing Warranty (6 Months)

Structural defects not caused by impact, misuse, improper handling, environmental exposure, or normal wear are covered for six (6) months from delivery. Structural defects refer exclusively to internal construction failures such as: soldering failure under normal wear, structural breakage not caused by external force, setting failure under normal conditions, clasp mechanism failure not resulting from impact.

Not covered: scratches or surface marks, loss of finish, bending caused by pressure or impact, stone damage caused by external force, improper storage, chemical exposure, normal wear over time. All claims are subject to inspection. Gambaro reserves the right to determine qualification. Repairs outside warranty coverage may be offered subject to evaluation and additional cost. This warranty does not imply lifetime coverage.

8. Care & Responsibility

Ownership and responsibility for proper care transfer upon confirmed delivery, without prejudice to applicable warranty rights. Gambaro is not liable for damage resulting from misuse, improper storage, impact, bending, chemical exposure, accidental damage, or failure to follow care guidance. Jewelry is meant to be worn. Subtle surface evolution over time reflects lived interaction and does not constitute a defect.

9. Limitation of Liability

To the maximum extent permitted by law, Gambaro shall not be liable for indirect, incidental, special, or consequential damages arising from the use or misuse of its products or website. Total liability shall not exceed the amount paid for the product giving rise to the claim. Nothing in these Terms excludes liability that cannot legally be limited.

10. Intellectual Property

All sculptural forms, designs, imagery, branding elements, and written content are the exclusive property of Gambaro. Unauthorized reproduction or commercial use is prohibited.

11. Force Majeure

Gambaro is not liable for delays or failures resulting from events beyond reasonable control, including natural disasters, transportation disruptions, governmental actions, or supply chain interruptions.

12. Governing Law

These Terms are governed by the laws of the Republic of Colombia. Disputes shall be submitted to the competent courts of Colombia.
